Introductions and Perspectives on Skilled Immigration


In our recent conversation were we hosted Anuj Christian, Founder of Fair America Organization, and Siddharth (Sid) we heard from two advocates of skilled immigration. Anuj shared his personal background and the long road he traveled to establish himself in the United States. He emphasized the discrimination that skilled immigrants often face, highlighting how country of birth can influence opportunities and outcomes. Sid built on these insights by clarifying common misconceptions about H1B visas. He explained how, despite being highly qualified, many foreign professionals encounter hiring challenges and systemic barriers to entry in the U.S. job market.


Challenges of H1B Visa Sponsorship
Both Anuj and Sid spoke at length about the inherent difficulties of the H1B visa process. They described how the complex sponsorship rules—combined with companies’ concerns about paperwork, fees, and legal risks—can deter employers from recruiting foreign talent. Contrary to popular narratives, these skilled workers are rarely in direct competition with American workers for jobs. In fact, restrictive policies and the scarcity of sponsoring employers often lead to a limited number of open positions for H1B holders, contributing to the perception that they are displacing American jobs.


Immigration Journey and Country-Specific Challenges
Anuj’s personal journey shed light on the specific hurdles people face based on their country of birth. Many highly educated immigrants, particularly from India, confront long wait times and stringent requirements that can stall their careers and personal lives. Sid highlighted the importance of bringing attention to these realities across the United States. He insisted that a merit-based system would not only be fairer to skilled professionals but would also benefit the American economy.


Fairness in the Skilled Immigration Process
Fair America’s mission underscores the need for a more equitable approach to skilled immigration. The organization believes that when highly trained professionals can access opportunities without being hindered by bureaucratic obstacles, the U.S. workforce only grows stronger. Their stance: skilled immigrants are job creators, innovators, and contributors to the nation’s prosperity. That’s why they call for more transparency and fairness—especially for those who have proven their abilities to contribute in key fields.


Discrimination Against Indian Immigrants
One example of discrimination emerged in a discussion about H1B visa holders of Indian origin who often face rigid workplace restrictions. Because their visa is typically tied to a single employer, these professionals can be left vulnerable to exploitation, fearful of losing their legal status if they attempt to negotiate for better wages or working conditions. This dynamic underscores the need to protect and empower these individuals as vital parts of America’s diverse workforce.


Exploitation of H1B Visa Holders
Sid and Anuj both called attention to how H1B holders can be subject to exploitation, ranging from excessive overtime to wage suppression. They advocated for “decoupling” visas from specific employers, thus freeing individuals to switch jobs if a position becomes untenable. This would grant visa holders greater mobility, enabling them to seek out fair compensation and pursue career growth on par with their American counterparts. The conversation also turned to the topic of country caps for permanent residency, which cause years (and sometimes decades) of waiting for green cards, particularly for Indian nationals.


Visa Qualification Complexities and Proposals
To address these challenges, the speakers proposed a hybrid, more flexible system for visa qualifications. They suggested a self-petition process to allow skilled immigrants to apply independently based on merit, rather than being dependent on the lottery system or individual employers. They also voiced support for legislation aimed at removing country-specific caps on employment-based green cards—crucial to easing the staggering backlog of over one million applicants who have been waiting for years.


Skilled Immigration and Manufacturing Sector Needs
The discussion broadened to highlight the national demand for specialized talent, especially in manufacturing. The newly introduced AI Manufacturing Resiliency Institute aims to fill critical skills gaps, noting that over two million jobs remain vacant due to a shortage of trained professionals. Fair America underscored how robust advocacy for skilled immigration could help close that gap, encouraging industry leaders to step forward and share their labor needs so the system can respond effectively.


Economic Importance of Skilled Immigration
As the conversation concluded, Anuj and Sid issued a call to action. They urged organizations to come together to eradicate discrimination against skilled immigrants and to push for more equitable policies. There was a strong commitment to continue championing reform, stressing that these issues affect not just immigrants, but America’s overall economic vitality. Their closing message was clear: if the U.S. wants to remain competitive on the global stage, it must address the failings in its immigration processes and ensure that talent—no matter where it comes from—has a fair chance to succeed.
